These Terms of Service (“Terms”) govern your access to and use of FixThatPothole (the “Service”), operated by Pothole Pros (“FixThatPothole,” “we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
1. Description of Service
FixThatPothole is a marketplace that connects three types of users: (a) members of the public who report potholes and other pavement defects (“Reporters”); (b) independent, certified repair contractors who claim and complete repair jobs (“Technicians”); and (c) property owners, homeowners' associations, property managers, and municipalities responsible for the roads or property where repairs occur (“Account Holders”). FixThatPothole facilitates reporting, job assignment, repair verification, and billing between these parties.
2. Eligibility and Accounts
Reporting a pothole does not require an account. Technicians and Account Holders must register for an account and provide accurate, complete information. Technicians must meet FixThatPothole's certification and equipment verification requirements before claiming certain jobs, particularly repairs on public roads. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
3. Technicians Are Independent Contractors
Technicians who use the Service are independent contractors and are not employees, agents, or partners of FixThatPothole or Pothole Pros. FixThatPothole does not supervise, direct, or control the manner in which Technicians perform repair work. Technicians are solely responsible for performing work safely, in compliance with applicable laws, permits, and industry standards, including any required traffic control measures.
4. Reports and Repair Verification
Reporters agree to submit accurate location information and photos to the best of their knowledge. FixThatPothole uses photo, timestamp, and location data to verify that a claimed repair was actually completed at the reported location before a Technician is paid and an Account Holder is billed. Account Holders or Reporters may flag a completed repair as unresolved or defective; such flags are reviewed and may result in the job being reopened, as described in our Refund & Cancellation Policy.
5. Payments and Fees
Account Holders agree to pay for verified, completed repairs either on a per-repair basis or through a recurring subscription, as selected at signup. Payments are processed through Stripe, a third-party payment processor, and by using the Service you also agree to Stripe's applicable terms. Technicians are paid out through Stripe Connect once a completed repair passes verification and administrative review. FixThatPothole may update pricing with advance notice to affected Account Holders.
6. Prohibited Conduct
You agree not to: submit false, misleading, or duplicate reports in bad faith; misrepresent your certification, equipment, or qualifications as a Technician; attempt to circumvent our repair verification process; or use the Service for any unlawful purpose.
7. Disclaimer of Warranties
The Service is provided on an “as is” and “as available” basis. While FixThatPothole verifies repairs using photo, timestamp, and location data, we do not guarantee the workmanship, durability, or outcome of any repair performed by an independent Technician. FixThatPothole disclaims all warranties, express or implied, to the fullest extent permitted by law.
8. Limitation of Liability
To the fullest extent permitted by law, FixThatPothole and Pothole Pros will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the Service or any repair performed by a Technician. Our total liability for any claim arising from the Service will not exceed the amount you paid to FixThatPothole in the twelve months preceding the claim.
9. Termination
We may suspend or terminate your access to the Service at any time for violation of these Terms or for conduct that we believe harms other users, FixThatPothole, or third parties. You may stop using the Service or cancel a subscription at any time, subject to our Refund & Cancellation Policy.
10. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws principles, and any dispute arising from these Terms or the Service will be subject to the exclusive jurisdiction of the state and federal courts located in Texas.
11. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated by posting an updated version on this page with a new “Last updated” date. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
